If i am married but separated can i still name my husbands name on the babies birth certificate?

of course it's his baby! i'm not married and my baby will have the father's last name... that's just how it works.

You should put the fathers name on the birth certificate. This has nothing to do with tax filings.
Reply:yes you can as long as its his baby and he acknowledges it.
Reply:You can name your child any name you want, doesn't have to be yours or anyone elses.

*EDIT* Thumbs down? Wtfudgesickles, you can name your baby ANY first or last name you can possibly think of. If your name is Jane Smith and the Dad, husband or not name is David Jones you can name your baby: ANYTHING. You can give your child any first and last name you could possibly think of.
Reply:In most states, if you are legally married, you have to put your husbands name on the birth certificate. You might want to look into it to make sure.
Reply:well by law if you are married and you have a baby the child is legally his.

Reply:If he is the father, you can list his name whether or not you are married. You don't need someone's permission to list them.
Reply:yes and if it comes down to it if you need to get child support thats just one thin you wont have to worry about doing
Reply:yes because he is still the father, i think u just need to have your marriage license with you or him present at the time. the only way his name wont be there is if he refuses and says the baby isnt his.
Reply:You can name your baby whatever you want to. If you think it will lead to a divorce though, I suggest naming the baby w/e last name you'll have afterwards. A lot of women take their maiden names back, or they keep their names as is. Best of luck!
