Do I have to put my babies fathers last name to collect child support?

When my son was born I put MY fathers last name on my baby instead of his dads last name since his dad is a jerk and is not around now im applying for child support will that affect my case?

Do I have to put my babies fathers last name to collect child support?
The baby's name has absolutely nothing to do with whether or not you get child support. You don't even have to allow visitation unless the court makes you.

You can get more information on how to file to child support by going to nolo.com which is a self-help law website. This link answers all sort of questions about child support, custody, etc.
Reply:no, you can put whatever last name you want on the child - doesn't affect child support.

and no, the dad can't just go in and switch the babies name.

You might have to do a DNA test if the father wants one, to prove the baby is his. if he wants this done - don't freak - this is normal when 2 people aren't married - and they just want to be 100% sure.
Reply:No, the baby does not have to have the fathers last name. If you live in the US, then if he wants to fight you about paternity, then Child Support Enforcement will require that he take a test, and if he is the father, he will have to pay for it also. If he does not dispute the fact that he is the father, then nothing will happen, and he will be required to pay. I wish that I would have given my daughter my last name when I gave birth, her dad turned out to be a loser, now I don't want to change her name b/c she is 5, and already knows her last name as her dad's last name. Wish I would have done what you did! Good choice! And good luck with the child support!
Reply:NO as long as paternity is deter mend the last name has nothing to to with anything......the check comes in your name anyway....word of advice with child support....don't expect to ever get it....the jerks always know how to work the system....I know my baby daddy is $2000 behind
Reply:Absolutely not. He will have to submit to a DNA test to confirm paternity when the child support proceeding happens. What you chose to name your child has nothing to do with the father's duty to support his child. Nor should it.
Reply:You can make up a last name if you want, it doesn't matter. When you file your case they will do a DNA test to confirm paternity if he doesn't just cooperate. It won't affect anything.
Reply:No. If he admits that he's the father, or you can prove that he's the father, he still has to pay child support.
Reply:It really shouldn't affect you . You can put any last name on a birth certificate.
Reply:NO.. ALL YOU HAVE TO DO IS TAKE HIM OR YOUR CASE TO COURT... THEY'LL AUTOMATICALLY DO A DNA TEST.
Reply:It should not be a problem. Just make sure when you file your case you know his full name and address. It will make it easier to track him down so they can do paternity testing.
Reply:My mom wanted to do that but I told her not to,because she wanted to connect my original last name with my dad's last name..which make it like a 20 letter last name.
Reply:No, not if you can prove paternity through a blood test.
