If father wont sign birth certificate, how can I have the babies last name the same as his?

Ok, my babies father is refusing to sign or acknowledge his son. I am due in May and need to know what i need to do to get my sons last name the same as his fathers as we are not married. Do i have to give my baby my last name or can I give the baby his last name without his permission?


Its a mess and the father is just using anything he can to get under my skin.......


Please help and tell me what I need to do legally before I have my baby.

Do you really want to saddle your son with the name of a man who obviously doesn't DESERVE to have a namesake?


You can name your baby anything you want, but really think about it.......you are going to be the person in this baby's life and you are going to be the person he/she looks to when times get tough or their is something to celebrate - give him a name that comes from someone he can be proud of not someone who is nothing more than a sperm donor.


(Then take the low-life father to court and nail him for child support!)
Reply:You can not but the last name of the father, once the father has been named without his permission. The best you can do is take him to court for a dna after the baby is born. They will not put his name of the certificate. You can call the hospital and they will verifty this. Do not let him ruin your babies birth. Take care of the dna and child support after you recover. Reply:to be honest, i would give the baby your name.


The babys father is obviously not interested so what would the point be? the reason of surnames is to keep a family name going, and if the father is not there, then he isnt family.





It will just be unfair on the child when you have to explain why he doesnt have your name, and why he has his dads name even though he isnt around.
Reply:Look the guy is obviously a looser. Do you really want your son to have his last name? I would push for him not to carry on that name.





Plus you can get a DNA test to make him pay child support.
Reply:In most states, you can name your baby anything you want (within reason). Aside from some registered trademark, last names are not intellectual property and one person cannot stop another from taking on a last name of their choice.





But ask yourself this -- why would you want to give your child the last name of a person who doesn't want to claim paternity?
Reply:In North Carolina I could get my child any last name I wanted too with no question ask. I thought it was strange of course I wanted it to have my husband's but the lady from records ask me.
