Can I change my babies last name if his dad is a illegal immigrant?

I have a 11 month old and his dad is a illegal immigrant. When I gave birth to my son his dad made everything possible and attended the delivery. He was there with me the whole time; he signed the Acknowledgement of Paternity and took me home the next day. The problem is I haven鈥檛 seen him since. I鈥檓 now with another person but my baby still has his last name. I dont know where to go to or who to call. If any of you can help me I'd really appreciate it.

I think that it might take alittle more than changing his name on paper. The father would have to sign over all rights to the child or atleast sign over permission for you to change the child's name. If he is an illegal immigrant then he might not be there to sign off on the name change. I would contact your local courts and ask them how you go about doing it and see if he contests it in anyway.
Reply:did he just disappear or have you tried to find him, he may have gotten deported and has no way to contact you
Reply:you can change the childs name, but you must do so legally, maybe through the courts


if you want your new person to adopt your child you can and take their name, but it requires i guess you trying to find the father and make him give up his paternity and if u can't find him, the courts may grant it after some time maybe

Reply:Has the State paid you any benefits for your child? If you go to court to change your son's name, they might expect the father to pay back any child support payments he skipped out on.
Reply:At this point, I don't think you can change last names nilly-willy like that. The child should have the biological father's last name.

Reply:You cannot unilaterally take your ex's name off your baby's birth certificate. He has to agree to any name change. Since he is the acknowledged father, he has as much right to the child as you have. Remember, the baby's father will be the baby's father forever. Your current boyfriend is just your current boyfriend. In a few years you may be with someone totally different.

Reply:I'm pretty sure you only need a court document filled in to change bubbas last name to yours. I think its only about $100.
Reply:Since you were not married at the time it doesn't seem important to change the name.
Reply:You would have to go through the courts in order to do so. It seems kind of petty, though. If your boyfriend wants to be the child's new father, he can legally adopt him. That would make a name change very easy.
