Whatever name is on the baby's birth certificate is the child's legal name. If the baby's birth certificate states his/her last name as the father's last name you will have to go to court and have it changed. It will cost money to do it. If you have legal custody of the baby it shouldn't be a problem to remove, but it'll have to go through the name change process. Go to your local courthouse which should have a department of public records. If the baby's father has shared custody, he will probably have to OK the name change as well.
